The accommodation and services provided were not as described, not of satisfactory quality, and failed to meet reasonable expectations, contrary to consumer protection standards.
Firstly, the room allocated to me (Room 408) was unacceptably cold during the night. The heating system was intermittent and unreliable, switching on and off without maintaining a habitable temperature. This rendered the room uncomfortable and unsuitable for proper rest.
Secondly, the breakfast service was substandard, with a very limited selection, no bakery items, and poor-quality coffee. While disappointing, these issues are secondary to the principal breach outlined below.
The primary and decisive factor in selecting this hotel was the advertised availability of the swimming pool and sauna facilities. These amenities were a material term of the booking and directly influenced my decision to reserve this hotel over alternative accommodation.
Upon arrival, I was informed that the swimming pool was closed due to staff shortages. This information was not disclosed prior to booking. The failure to notify guests in advance constitutes misrepresentation of facilities.
This caused significant distress to my family. I had expressly promised my family, including my young daughter, that the swimming pool and sauna would be available. My daughter had already changed into her swimming costume and was extremely excited. Discovering that the facilities were unavailable caused her visible upset and resulted in substantial disappointment to the entire family. The purpose of the stay was therefore fundamentally undermined.
Had the closure of the swimming pool been disclosed at the time of booking, I would not have entered into this contract.
